REIUS advised Hennigsdorfer Elektrostahlwerke GmbH (H.E.S.) on the conclusion of public-law agreements with the State of Brandenburg and the District of Oberhavel. These agreements are intended to exclude H.E.S. from the newly designated drinking water protection area for the Stolpe waterworks, which supplies drinking water to approximately 600,000 residents in Berlin and Brandenburg.
Under the agreements signed on 12 February 2026 by the Minister for the Environment of the State of Brandenburg, Ms Hanka Mittelstädt, the District Administrator of Oberhavel, Mr Alexander Tönnies, and the management of H.E.S., H.E.S. undertakes to establish and operate a monitoring and protective well system. In return for this alternative protection system, H.E.S. is granted the flexibility to pursue further investments at its site, once the relevant framework conditions (in particular electricity prices for energy-intensive industries) allow for this. The agreements now concluded create the legal basis for such investments.
Dr Jörn Kassow has been advising H.E.S. on an ongoing basis on all matters relating to planning, permitting and environmental law, and has legally supported the development and implementation of the monitoring and protective well system from the outset.
